1. Acceptance
These Terms govern Electionprachar.com, operated by Leelai Technologies, a sole proprietorship of Lalit Mahajan (“Operator”). Address: Plot No. 23, Prabhat Colony, Jalgaon, Maharashtra, India. Contact: contact@electionprachar.com; +91 9371094005. By using the Website you agree to these Terms and the Privacy Policy.
2. Nature of the Website
Electionprachar.com is an online directory and discovery platform where visitors can browse independent providers of election and campaign-related products and services, including software, digital marketing, messaging, strategy, research, production, printing, events, manpower, design, AI/data technology, development, call centres, PR, legal documentation, logistics, training and Bluetooth printers.
3. Our role — directory only
We provide our own directory, listing, subscription, paid visibility and advertising services.
We do not provide, execute, supervise or fulfil services listed by providers.
We do not act as agent, broker, representative or negotiator for visitors or providers.
We do not negotiate customer-provider contracts or set their prices or commercial terms.
We do not collect, hold, route or distribute visitor enquiries or customer-to-provider service payments.
Visitors independently contact providers using contact methods shown on listings.
A listing, advertisement, verification label or featured placement is not endorsement, certification or guarantee.
Nothing excludes duties or liabilities imposed on the Operator by law for its own platform services.
4. Eligibility and accounts
Provider accounts, listings and paid platform services are intended for individuals aged 18 or above and businesses acting through an authorised adult. Users must provide accurate information, protect credentials and update inaccurate details.
5. Independent provider relationship
Visitors and providers are independent parties. They are responsible for checking identity, credentials and authority; agreeing scope, price, taxes, timelines, payment, cancellation, refund and warranty terms; and documenting their arrangement. Any contract is made directly between them. The Operator is not a party merely because a provider is listed.
6. Listings and due diligence
Provider information may be submitted by providers and may change. We do not guarantee every listing is accurate, complete, current, lawful, available or independently verified. Visitors should confirm credentials, licences, prices, taxes, references, deliverables and terms directly with the provider.
7. Visitor responsibilities
Use the Website lawfully and provide accurate information when contacting the Operator.
Verify providers independently and obtain written quotations/agreements where appropriate.
Do not scrape listings unlawfully, spam, harass providers or misuse contact details.
Do not upload personal data about another person without authority or lawful basis.
Respect intellectual property, privacy and other legal rights.
8. Provider responsibilities
Provide accurate, current and lawful business, contact and service information.
Hold licences, registrations, permissions and approvals required for offered services.
Disclose prices, taxes, deliverables, limitations, delivery, cancellation and refund terms directly to customers.
Honour customer agreements and handle personal information lawfully and securely.
Use only content and logos owned or authorised for use.
Comply with election, advertising, consumer, privacy and other applicable laws.
Do not use unlawfully obtained voter databases, unauthorised personal data, deceptive impersonation or unlawful spam.
9. Direct contact — no enquiry distribution
The Website is not an enquiry-routing service. Under the current model, visitors cannot submit one enquiry for forwarding to one or multiple providers. The Website does not send visitor contact details to providers, rank providers to distribute leads or sell leads. Visitors initiate contact themselves using provider contact methods. Direct calls, emails, WhatsApp messages or visits occur outside the Website’s enquiry systems. If this model changes, updated terms and privacy notices will be published before enabling the feature.
10. Provider disputes
Complaints about price, payment, scope, quality, delay, cancellation, refund, warranty or performance should ordinarily be raised directly with the provider. The Operator does not decide contractual liability, compel provider refunds or arbitrate visitor-provider disputes. We may review listings and take moderation action where there is credible evidence of false information, fraud, unlawful conduct or breach. Statutory remedies remain available.
11. Provider cancellations and refunds
Providers are responsible for disclosing their own cancellation, rescheduling and refund terms before accepting payment. Payments made directly to providers are not held by the Operator and cannot be refunded by the Operator. Applicable statutory rights remain unaffected.
12. Platform listings, subscriptions and fees
Free listings, paid subscriptions, featured placements and advertising may be offered. Plan name, price, taxes, duration, limits, activation and renewal must be shown before purchase and are governed by the Listing, Subscription & Advertising Terms. Renewal is intended to be manual; automatic renewal is not intended. Platform fees are for Operator services, not provider services.
13. Platform refunds
No term excludes rights that cannot lawfully be excluded.
14. Verification and sponsored placement
Only Email Verified labels are offered. They confirm control of the listed email address only; they do not prove business existence, identity, registration, competence, quality or government approval. Paid visibility must be labelled Sponsored, Advertisement or Featured – Paid Placement.
15. Election content and advertising
Users and providers must comply with applicable election laws, Election Commission directions, Model Code of Conduct where applicable, political advertising certification requirements, campaign restrictions and other laws. We may request approvals or certifications before political advertising and reject or remove unlawful or misleading content. No user may promise guaranteed electoral victory.
16. Prohibited conduct
False, misleading, fraudulent or impersonating listings or advertisements.
Unauthorised use of another person’s identity, business, party, candidate or government body.
Unlawful collection, publication, sale or use of voter data or personal information.
Malware, phishing, credential theft, unauthorised access or interference with Website security.
Unlawful scraping, bulk extraction, resale or republication of directory data.
Spam, harassment, threats, abusive content or infringement of rights.
17. Intellectual property and submitted content
Website branding, design, text, graphics and software belong to or are licensed to the Operator. Providers grant a limited, non-exclusive, royalty-free licence to host, format, reproduce and display submitted listing content solely to operate and present the listing and Website. Providers warrant that they have rights to submit it. The licence ends when content is removed, subject to backups and legal records. Ownership is not transferred.
18. Suspension and termination
We may reject, restrict, suspend or remove accounts, listings, advertisements or features for breach, false or unlawful content, infringement, fraud, security risk or legal requirement. Where practicable and lawful, notice and an opportunity to respond will be given. Suspension does not itself decide refund entitlement.
19. Third-party links
External websites, phone, email, WhatsApp and other contact methods are provided for convenience. We do not control third-party services, content, availability, security or privacy practices.
20. Availability and changes
We aim for reliable operation but do not guarantee uninterrupted or error-free availability. Features may change for maintenance, security, legal or operational reasons. Material changes will be published with a revised effective date and additional notice or acceptance where required.
21. Limitation of liability
To the maximum extent permitted by law, the Operator is not liable for indirect or consequential loss arising from independent visitor-provider dealings, provider non-performance, provider statements, third-party websites or inability to access the Website. This does not exclude liability that cannot lawfully be excluded, including responsibility for the Operator’s own platform services.
22. Indemnity
To the extent permitted by law, users are responsible for claims and losses arising from their breach, unlawful conduct, false submissions, infringement or misuse of personal information. This does not cover the Operator’s own misconduct or breach.
23. Governing law and jurisdiction
These Terms are governed by Indian law. Subject to mandatory statutory forums and non-excludable jurisdiction, courts of competent jurisdiction in Jalgaon, Maharashtra may hear disputes involving the Operator to the extent legally valid. This does not restrict access to consumer commissions, tribunals or authorities whose jurisdiction cannot be excluded.
